Pre-Employment Checks

We take a look at what is important for your new starters.

 

 

When you are employing someone, it can be difficult to remember what you should capture from them and what is important.

Lets look at what should be in your top 3

  1. A right to work in the UK, as an Employer you need not only to request to see this, but you need to keep a photocopy of the original document. This is in line with legislation and is covered under the Immigration, Asylum and Nationality Act 2006.
  2. You may want your new Employee to provide you with employment or character references, we normally advise 2 for employment purposes.
  3. Depending on your industry or the role your Employee is carrying out you may require them to undergo a criminal record check, these are called DBS (Disclosure Barred Service) checks, these checks are due to when their employment with you means you they are likely to come into contact with children or vulnerable adults (or certain other particular circumstances), you should discuss the arrangements with them prior to confirming their initial appointment.

 

You have a duty as an Employer to follow up with your Employee where you either have not received any of these back or you are not satisfied and you can reserve the right to end the probationary period should this be the case.

 

Let’s recap – your top 3 should consist of:

  • UK Right to Work

  • Reference Checks

  • DBS Checks (where there is a requirement in the role/industry)
